Food Safety Guidelines
The Retail Food Inspection program is responsible for enforcing the provisions of the Kansas Food, Drug, and Cosmetic Act (FD&C) that pertain to food. This act is found in Kansas Statutes Annotated (KSA) 65-617 to 65-689. The program is also responsible for enforcing the provisions of the Kansas Food Service and Lodging Act that pertain to food service in retail food stores. This act is found in KSA 36-501 to 36-517.
Businesses that provide non-meat or poultry food products to anyone other than the end consumer are considered food manufacturers. These facilities are required to comply with 21 Code of Federal Regulations (CFR) Parts 100 to 169, as adopted by reference.
Food businesses that supply food to the end consumer are considered retail food establishments. These facilities must comply with the 2005 KDA Food Code.
Inspectors verify compliance with these regulations during routine and complaint inspections. If a certain number of violations are observed, or if certain types of violations are not corrected on site, notice of non-compliance is given to the facility and a follow-up inspection is scheduled. If the inspector observes repeated violations during the follow-up inspection, administrative action may be taken. These actions may include summary orders, civil penalties, license suspension, and/or license revocation.
