Farmers' Market Sales

Retail sales of food products is regulated by the Kansas Department of Agriculture.  Our goal is to insure that all foods offered for sale are safe and wholesome.

Non-potentially Hazardous Foods 

The sale of non-potentially hazardous foods is allowed at farmers markets.  Non-potentially hazardous foods include:

  • baked goods (such as cookies, breads, cakes, cinnamon rolls and fruit pies) 
  • fresh fruits
  • vegetables
  • nuts
  • honey
  • jams and jellies

Potentially Hazardous Foods 

The sale of potentially hazardous foods is restricted to protect the public from foodborne illness. Potentially hazardous foods are foods that consist in whole or in part of:

  • milk or milk products
  • eggs
  • meat
  • poultry
  • fish
  • home canned products (except jams and jellies)

Examples include cream or meringue pies, hamburgers, hot dogs, burritos, egg rolls, jerky, summer sausage and similar products, canned salsa, pickles and tomatoes.

Guidelines for Food Sales at Farmers' Markets

  • Ready-to-eat potentially hazardous foods may be sold only from a vendor in compliance with all applicable regulations.
     
  • Packaged potentially hazardous foods must be from approved sources.
     
  • The sale of fresh meat or meat products, fresh seafood and poultry is PROHIBITED.
     
  • The sale of frozen meats is allowed if it's from an inspected source, is labeled properly and has been maintained frozen.
     
  • Eggs may be sold if maintained at 45° F.  Egg producers should register with The Kansas Department of Agriculture.
     
  • The sale of home canned products, except jams and jellies, is PROHIBITED.
     
  • Home grown produce may be sold, provided that any pesticide use complies with label directions.  Produce for sale must be whole, cut fruits and vegetables may not be sold, (example half a watermelon).
     
  • Packaged products must be labeled with the common name of the product, and the name and address of the producer.
     
  • All foods on sale or display must be effectively protected from contamination.
