Pesticide Product Registration

Kansas law does not require pesticide devices to be registered but all chemicals marketed with any pesticide claim must be registered in Kansas. This includes any chemical substances exempted from federal registration by the U.S. Environmental Protection Agency (EPA).
Pesticide products are registered annually by submitting the registration form (Pesticide Products Application) and submitting the appropriate registration fee - $150 each for antimicrobial products and $210 each for all other pesticide products. The registration period is from January 1 to December 31. Registrations are not pro-rated for partial years.
It is the responsibility of the registrant to submit revised labels before products are distributed.
Alternate Brand Names
K.S.A. 2-2204(a) provides that products which have the same formula, and are manufactured by the same person, the labeling of which contains the same claims and the labels of which bear a designation identifying the product as being the same pesticide may be registered as the same product. The Kansas Department of Agriculture allows only products with exactly the same pesticidal claims, application rate, and sites of application as a primary registered product to be registered as alternate brand name products or ABNs as they are often called.
When requesting registration of a product as an alternate brand name, be sure to identify the primary product on the registration application. The label of the primary product, as indicated on the application, will be compared to the label of the product being submitted for alternate brand name registration. If the alternate brand name criteria is not met, the alternate brand name registration will be denied. Failure to indicate the primary product on the application for alternate brand name product registration will result in denial of the alternate brand name registration.
Any products denied registration as an alternate brand name may be registered as a separate product when the registration fee is paid.
