Licensing Requirements
A Live Plant Dealer License is required for each location from which individuals or businesses:
- grow or sell live plants
- plant, transplant, or move live plants for compensation
- give live plants as a premium for promotional or advertising purposes
Live plants include any living plant, cultivated or wild, or any part thereof that can be propagated except:
- cut flowers and greenery not used for propagation
- seeds or sets of any kind
- aquatic plants for use in indoor aquariums
- fruits and vegetables for food or feed
- all field and forage crops
Any person or business offering live plants for sale in Kansas is required to obtain a Live Plant Dealer License. This is an annual business license that expires each year on January 31.
