Black Stem Rust Law

The Kansas Barberry Eradication Act was enacted in 1951. This statute declared black stem rust and common barberry public nuisances, and required the destruction of barberry plants susceptible to the black stem rust fungus. Black stem rust is a destructive disease of small grains including wheat, barley, oats, and rye. Common barberry can serve as an alternative host or reservoir for the disease. Activities to ensure compliance are currently included in live plant dealer inspections and as part of a cooperative arrangement with the United States Department of Agriculture’s Animal and Plant Health Inspection Service, Plant Protection and Quarantine (USDA-APHIS-PPQ).
