Food Safety

Application for Retail Food Store (Retail Food Store, Food Service within a Retail Food Store, Ice Cream Truck, and Vending Machines) 
Pursuant to the Kansas Food, Drug and Cosmetic Act, K.S.A. 65-601 et seq.; and the Food Service and Lodging Act, K.S.A. 36-501 et seq., a food service establishment in a retail food store and a retail food store shall be licensed by the Kansas Department of Agriculture. If there are multiple individual businesses with different owners within your facility, each requires an individual license. Failure to register could result in regulatory action. This license is valid from January 1 through December 31st.

Restaurant Application (Restaurant, School Cafeteria, Senior Meal Site, Satellite School Cafeteria, Satellite Senior Meal Site, Caterer, or Mobile Food Vendor)
Pursuant to the Kansas Food Service and Lodging Act, K.S.A. 36-501 et seq., a food service establishment shall be licensed by the Kansas Department of Agriculture. This license is valid from January 1 through December 31st.

Food Processing or Storage Application (Food processors, food warehouses, storage facilities)
Food processing plant is a commercial operation that manufactures, packages, or labels food for human consumption but does not provide food directly to the consumer. For a Food Processing License, you will need to fill out the Application for Food Processing or Food Storage License.  

Food storage facility is a commercial operation that stores food for human consumption but does not provide food directly to the consumer.  There is a $100 application fee. License fee is based on size of facility. Licensure expires December 31.

Vending Machine Application (Vending Machine Companies and Dealers) A business that operates vending machines that offer food that requires temperature control for safety needs a Vending Machine Company License.  This license has an annual $30 license fee and an additional fee of $3 per vending machine.

Vending machine companies are required to report the location, name brand, and serial number of all vending machines as part of the application.  In addition, all newly acquired vending machines must be reported to the department within 10 days and a $3 license fee per new machine must be submitted.

A business that manufactures vending machines that dispense food that requires temperature control for safety needs a Vending Machine Dealer License.  The annual license fee is $25.

Vending machine dealers are required to report all vending machine sales to the department monthly.  The report must include the name and address of the purchaser, the brand name and serial number of the machine, and its sale price.

Lodging

Lodging Establishment Application 
A lodging establishment is considered a hotel, rooming house or boarding house. Application fee is based on the total number of rooms with an additional licensure fee depending on the number of rooms. If complementry breakfast is offered to guests, no Food Service license is required. You will need to have a Food Service license if you plan to serve food to the public.

Egg

Egg Application
Any person selling, offering for sale or distributing, or grading eggs in Kansas needs to obtain a license. A producer of eggs when selling ungraded eggs of the producer's own flock production is exempted if the producer owns 50 or fewer hens.

Licensees shall keep and retain for 3 years such records required to verify the quanitity of eggs bought, sold, offered for sale or distributed in the State of Kansas. Inspection fee of 3.5 mills for each dozen of graded eggs sold, offered or exposed for sale or distributed needs to be reported quarterly. Minimum fee is $15. License Fee is $5 and expires December 31.
